Redbull the Edge - Official Rules

Please note that no purchase is necessary to enter or win. A purchase will not increase the odds of winning.

1. The Promoter and Event Partners
The Promoter is: Zermatt Tourismus (CHE-107.013.406), Bahnhofplatz 5, 3920 Zermatt, Switzerland ("Promoter").
 
Event Partners are: Air Zermatt AG (CHE-105.759.819), Spissstrasse 107, 3920 Zermatt ("Air Zermatt"), Genossenschaft Zermatters (CHE-228.535.289), Bahnhofstrasse 58, 3920 Zermatt ("ZERMATTERS"), Red Bull Media World of Red Bull Ltd. (CHE-102.285.067), Poststrasse 3, 6341 Baar, Switzerland ("Red Bull Media World") and Zermatt Bergbahnen AG (CHE-107.913.882), Schluhmattstrasse 28, 3920 Zermatt, Switzerland ("Zermatt Bergbahnen") (together the "Event Partners").
 
2. Eligibility
 
2.1. The Redbull the Edge (the "Game") is open to residents of any country who are at least eighteen (18) years of age as of the time of entry. The following persons are excluded from participation: (a) employees of the Promoter; (b) employees of the Event Partners and Red Bull or their holdings or subsidiary companies; and (c) employees of agents or suppliers of the Promoter, the Event Partners and Red Bull, who are professionally connected with the Game or its administration.
 
2.2. All entrants must be in good physical shape, since this will be needed to claim the prizes, particularly the mountain hike.
 
2.3. In entering the Game, entrants confirm that they meet all eligibility criteria. The Promoter may require entrants to provide proof regarding eligibility criteria. Each entrant warrants that all information submitted by them is accurate and complete.
 
2.4. The Promoter reserves all rights to disqualify entrants if, in the Promoter's sole discretion, there are any doubts regarding the eligibility criteria and/or if the entrants' conduct is contrary to the spirit or intention of the Game.
 
3. How to Enter
 
3.1. The Game will run from Tuesday, April 2, 2024, at 12:01:00 CET until Sunday, April 28, 2024, at 23:59:59 CET (the "Game Period") and the Promoter reserves the right to conduct further Games in the future which will be announced accordingly on the Game website at www.zermatt.ch/en/redbull. The Game will consist of four (4) separate entry periods (each an "Entry Period") and four (4) separate drawings (each a "Drawing") per year. Each Entry Period will be announced one (1) week prior to its beginning on the Game website at www.zermatt.ch/en/redbull. In principle, the duration of each Entry Period is one (1) month.
 
3.2. The Drawings will be announced on the Game website at www.zermatt.ch/en/redbull and the Promoter reserves the right to change or extend any Entry Period or Drawing at its sole discretion which will also be publicly announced via the Game website.
 
3.3. In order to be eligible for a particular Drawing, entrants must submit an entry during the relevant Entry Period. Once an entry is made it will not be carried forward to any remaining Drawings (if any). Hence, to be eligible for all four (4) Drawings entrants must participate separately during all four (4) Entry Periods.
 
3.4. In order to enter the Game entrants must visit the Game website at www.zermatt.ch/en/redbull and complete the entry form. Entrants must provide their title, full name, date of birth and a valid email address and optionally their address, zip code, residential area and country, confirm their acceptance to these Official Rules and submit their entry.
 
3.5. All entries for the Game must be received by the Promoter during the Game Period. All entries received outside the Game Period are automatically disqualified.
 
3.6. There is a limit of one (1) entry per person and household during each Entry Period and a limit of one (1) prize per person and household during the Game Period. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
 
3.7. The Promoter will not accept entries that are: (a) automatically generated by computer; (b) completed by third parties or in bulk; (c) illegible, have been altered, reconstructed, forged or tampered with; or (d) incomplete. Entries must not be made by one (1) person using multiple email addresses, social media accounts or identities.
 
3.8. Proof of transmission is not proof of receipt of an entry.
 
3.9. The Promoter cannot guarantee continuous, uninterrupted, or secure access to the entry website and is not responsible for any disruption to the Game or the entry website due to technical problems or otherwise due to events outside of its reasonable control.
 
4. Winners
 
4.1. One (1) main prize winner as well as four (4) runners-up will be chosen for each Drawing from all eligible entries received during the relevant Entry Period through a random draw performed by a computer process and as described in Clause 4.2. The determination of the respective price winners is final.
 
4.2. In general, the prize winner of each Drawing will be drawn on the Monday after the Entry Period has ended. The Promoter, however, reserves the right to change the anticipated drawing date at its sole discretion. In any case, the prize winner will be announced at the latest ten (10) days after the Entry Period of each Drawing ends.
 
4.3. The odds of winning depend on the number of eligible entries received during each Entry Period.
 
4.4. The winners list will only be made available to the Event Partners and if anyone who entered the Drawing requests such information within one (1) month after the end of the Entry Period via email to marketing@zermatt.swiss based on a valid legal basis and only to the extent the Promoter has a legal duty to share such information. In any event, the Promoter may also provide such information to relevant regulators on request if a statutory or regulatory duty applies.
 
5. The prizes
 
5.1. Main prize: Each prize winner will receive the prize "Adventure weekend in Zermatt", which includes the following prize package:

Two (2) nights of accommodation in Zermatt Zermatt Tourism The prize winner and one companion of his or her choice are eligible to stay two (2) consecutive in a four (4) star hotel in Zermatt, double-bedroom with breakfast included.
ZERMATTERS Mountain guide tour ZERMATTERS

The prize winner and one companion of his or her choice are eligible to go on a mountain tour with a tour guide provided by ZERMATTERS.

The mountain tour will be subject to the season. The value of the mountain tour is CHF 610.- including VAT.

Flight with Air Zermatt Air Zermatt

The prize winner and one companion of his or her choice are eligible to go on a round trip Matterhorn standard, i.e. a helicopter flight for twenty (20) minutes.

The value of the Air Zermatt flight is CHF 500.- including VAT.

Three (3) days ski ticket for the cable cars of Zermatt Zermatt Bergbahnen

The prize winner and one companion of his or her choice get the skipass international, i.e. ski tickets for all cable cars of Zermatt for three (3) consecutive days.

The value of the skipass is up to CHF 274.- including VAT.

5.2. Runners-up: In addition to the main prize, four (4) runners-up prizes which include the following will be drawn:

5.3. Prizes are subject to availability. The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances make it necessary to do so.

5.4. Prizes are non-negotiable, non-exchangeable and non-transferable. There is no cash alternative for any of the prizes.
 
5.5. The Promoter is not responsible for any additional, variable costs and/or expenses, taxes or other charges in relation to any prize.
 
6. Claiming the prize
 
6.1. Prize winners will be notified by email by the Promoter using the email address provided via the entry form within fourteen (14) days of the relevant Drawing. They must respond to the winner notification as instructed in the winner notification email and provide a valid postal address in order to claim their prize.
 
6.2. The Promoter will make all reasonable efforts to contact the prize winners. If a prize winner cannot be contacted or is not available, or has not claimed the prize within fourteen (14) days of the winner notification email, then the prize will be forfeited and the Promoter reserves the right to select another winner in accordance with the process described in Clause 4.
 
6.3. Prizes will be sent to the prize winners by post or courier (as Promoter or Event Partners elect) from the Promoter's (or Event Partners) headquarters within fourteen (14) days of the winners notifying the Promoter of their postal address.
 
6.4. The Promoter accepts no responsibility for the prize being lost, stolen, delayed or damaged during delivery.
 
6.5. Prize winners can choose when they would like to redeem the prize they win in each Drawing. Each prize is valid for one (1) year from date of issue. The prize winners have to write an email to marketing@zermatt.swiss at least three weeks prior to redemption, otherwise, the Promoter cannot and will not be able to guarantee the availability of any prize. Please note, that in peak season the Promoter cannot and will not be able to guarantee the availability of any hotel room. In order to claim the prize "Two (2) nights of accommodation in Zermatt", entrants should therefore redeem their prize very early in advance, especially if they want to stay in a specific hotel in Zermatt during peak season.
 
7. Liability
 
7.1. Insofar as permitted by law, the Promoter excludes any responsibility for entries that are incomplete, lost, damaged, delayed in transit or that cannot be submitted as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure, or any other reason beyond the reasonable control of the Promoter.
 
7.2. Insofar as permitted by law, the Promoter excludes any liability for any circumstances beyond its reasonable control that prevent or delay the completion of a Game, the award or delivery of any prize, or any prize being redeemed or fully enjoyed by a winner in the manner and at the time specified.
 
7.3. Insofar as is permitted by law, the Promoter, its agents, auxiliaries or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of them redeeming any prize.
 
7.4. The prize winners claim the prizes at their own risk. Entrants are, in particular, aware of the dangers and risks that exist in alpine terrain.
 
8. Data protection and publicity
 
8.1. Within the scope of the Game, entrants will be providing their title, full name, date of birth and contact details including their email address and, where the entrants have provided additional information, their address, zip code, residential area and country to the Promoter. The personal data of the entrants will be collected, processed, and used for the purpose of conducting the Game, to send newsletters (if you have consented thereto) and as otherwise outlined in these Official Rules or the entry path for the Game ("Purposes").
 
8.2. Zermatt Tourism of Bahnhofplatz 5, 3920 Zermatt, Switzerland is the data controller of the personal data processed for the Purposes. Personal data collected within the context of participation will be treated in accordance with the provisions of applicable data protection laws and are not passed on to third parties, except to the Event Partners.
 
8.3. In order to participate in the Game, it is necessary for entrants to provide the Promoter with the abovementioned personal data. The legal basis for processing the personal data under EU law is the fulfillment of contractual duties and the Promoter's interest in organizing and carrying out the Game according to Article 6, paragraph 1, lit b) and f) GDPR.
 
8.4. With regard to their personal data, entrants are entitled to assert their legal rights to access, rectify, block, delete, and revoke their consent to processing such data vis-a-vis the Promoter. Within the EU, participants also have a right to data portability. In case entrants believe that their personal data is not processed in accordance with applicable data protection law, they also have a right to lodge a complaint with the competent data protection supervisory authority – Swiss Federal Data Protection and Information Commissioner.
 
8.5. Personal data will only be stored for as long as is necessary for the purpose for which the data was collected, e.g. until all prizes have been claimed, or as long as consent is not withdrawn. 8.6. Air Zermatt will collect and process the personal data of the entrants, which they receive from the Promoter, for the purpose of sending a onetime letter via email to all the entrants. After that Air Zermatt will only use the entrants contact details to send newsletters, if the entrants have consented thereto. For the sending of newsletters to entrants from Air Zermatt, Air Zermatt is considered the data controller of the personal data received. Since Air Zermatt will be using these personal data for the purpose of their newsletter, personal data will be stored as long as the entrants are subscribed to the newsletter. Entrants can unsubscribe from the newsletter at any time via the link provided in the newsletter. Once the entrants unsubscribe from the newsletter, the personal data will no longer be stored and will be deleted in accordance with applicable legal provisions. 8.7. ZERMATTERS will collect and process the personal data of the entrants, which they receive from the Promoter, for the purpose of sending a onetime letter via email to all the entrants. For the sending of this onetime letter to entrants from ZERMATTERS, ZERMATTERS is considered the data controller of the personal data received. After this letter, the personal data will no longer be processed or stored and will be deleted in accordance with the applicable legal provisions. 8.8. Zermatt Bergbahnen will collect and process the personal data of the entrants, which they receive from the Promoter, for the purpose of sending newsletters if the entrants have consented thereto. For the sending of newsletters to entrants from Zermatt Bergbahnen, Zermatt Bergbahnen is considered the data controller of the personal data received. Zermatt Bergbahnen and Zermatt Tourism collaborate and therefore, some of those newsletters are sent by Zermatt Bergbahnen and Zermatt Tourism together. In cases where a newsletter is sent jointly by Zermatt Bergbahnen and Zermatt Tourism, Zermatt Bergbahnen and Zermatt Tourism are considered the data controllers of the personal data received. Since Zermatt Bergbahnen will be using these personal data for the purpose of their newsletter, personal data will be stored as long as the entrants are subscribed to the newsletter. Entrants can unsubscribe form the newsletter at any time via the link provided in the newsletter. Once the entrants unsubscribe from the newsletter, the personal data will no longer be stored and will be deleted in accordance with applicable legal provisions. 9. General
 
9.1. If there is any reason to believe that there has been a breach of these Official Rules, or other objective reasons that justify doing so (e.g. unfairly manipulating or otherwise influencing the results of the Game) the Promoter may, at its sole discretion, reserve the right to exclude entrants from participating in the Game and/or from claiming any prize.
 
9.2. The Promoter reserves the right to hold void, suspend, cancel, or amend the Game at any time, at its sole discretion.
 
9.3. The decision of the Promoter regarding any aspect of the Game is final and binding. Entrants have no legal claim against the Promoter in relation to any aspects of the Game.
 
9.4. If any provision of these Official Rules (or portion thereof) is invalid, illegal or unenforceable, the validity, legality or enforceability of the remainder of the Official Rules will not be affected or impaired.
 
9.5. The Promoter's failure to assert its rights in relation to any breach of these Official Rules shall not constitute a waiver of such rights, nor will any such waiver be implied.
 
9.6. These Official Rules shall be governed by Swiss law, and the parties submit to the non-exclusive jurisdiction of the courts of Visp.
 
9.7. If there is a difference between the German, English or French version of these Official Rules, the English version shall prevail.
