Terms of participation

Alpine Experience Zermatt

1.       Promoter, Event Partners and Participants

Promoter of the Alpine Experience Zermatt ("Event") is Bike Agentur Hahn (009/145716812), Neuhauserstrasse 12, 78464 Konstanz, Germany ("Promoter"). 

Event Partnersare: Zermatt Tourismus (CHE-107.013.406), Bahnhofplatz 5, 3920 Zermatt, Switzerland ("Zermatt Tourismus"), Mammut Sports Group AG (CHE-101.012.710), Birren 5, 5703 Seon, Switzerland ("Mammut"), Triple2 Sportswear GmbH (German commercial register, HRB 209934), Brunnenweg 1, 27283 Verden, Germany("Triple2") and The Bike Company AG Transalpes Bike Manufaktur (CHE-292.812.780), Alte Affolterstrasse 1, 8909 Zwillikon, Switzerland ("Transalpes") (together the "Event Partners").

Anyone who fulfils and accepts the present Terms of Participation may apply for the Event ("Applicants"). From the Applicants, the Promoter and the Event Partners will select and subsequently contact ten participants ("Participants") who will be allowed to participate in the Event. The Promoter will carry out the Event with the selected Participants.

 

2.       Requirements

2.1.        The Event is open to persons who are at least eighteen (18) years of age as of the time of entry.

2.2.        The following athletic requirements apply for the specialist day according to the Event programme (https://www.zermatt.ch/en/Alpine-Experience-Zermatt):

Biking:

  • Elevation approx. 1000 m
  • Technical sections up to S2 and S3

Climbing:

  • Climbing level min. 6a
  • Little to no multi pitch experience
  • Rope handling: mastering the belay technique   

Trail running:

  • Running on red and white hiking trails
  • Distances of 15–20 km with ascents of approximately 1000 m (steep uphill sections, flat and downhill running) 

2.3.        On the combined experience day, where you will participate in all the sports, the programme is adapted to the level of the Participants. 

2.4.        In entering the Event, Applicants confirm that they meet all eligibility requirements. The Promoter may require Participants to provide proof regarding eligibility requirements. Each Applicant warrants that all information submitted by them is accurate and complete.

 

3.       Data Protection

3.1.        As part of the registration for the Event, Applicants submit their title, first and last names, their address (street, postcode, city and country), their email address, their mobile phone number, an application photo or video of themselves and, where Applicants have also provided this, their Instagram account. The personal data of the Applicants and later of the Participants will be collected, processed and used by the Promoter and the Event Partners for the selection and contacting of the Participants, for the execution of the Event, for sending newsletters (if the Applicants or Participants agree to this) and as described in these Terms of Participation ("Purposes").

3.2.        The Promoter is responsible for the processing of personal data for the aforementioned purposes. Information on the processing of personal data, in particular on your rights, by the Promoter, can be found here: https://www.bikeagentur.com/datenschutz/.

3.3.        As an Event Partner, Zermatt Tourismus is responsible for the registration of the Applicants. Zermatt Tourismus operates a registration platform for this purpose and transmits the Applicants' data to the Promoter and all Event Partners as the Promoter's data processor.

3.4.        Personal data of the Applicants will only be kept until the selection of the ten Participants and personal data of the selected Participants until the end of the Event, or as long as consent has not been revoked. The submitted application photos or videos will be deleted immediately after the selection of the ten Participants.

3.5.        The Event Partners are responsible for the processing of personal data regarding the sending of newsletters to the Applicants and Participants. Applicants can unsubscribe from the Event Partners' newsletters at any time. 4.       Liability

4.1.   Insofar as permitted by law, Zermatt Tourismus excludes all liability and responsibility for registrations that cannot be submitted due to a technical malfunction, system, satellite, network, server, computer hardware or software error, or any other reason beyond the reasonable control of Zermatt Tourismus.

4.2.   Insofar as permitted by law, Zermatt Tourismus excludes its liability and responsibility for any circumstances beyond its reasonable control that prevent or delay participation in the Event in the manner and at the time specified.

4.3.   Insofar as permitted by law, neither Zermatt Tourismus, its agents, auxiliaries nor its distributors shall be responsible or liable in any way to compensate Participants. They accept no liability whatsoever for any loss, damage, injury or death resulting from participation in the Event.

4.4.   Participants take part in the Event at their own risk. Participants are specifically aware of the dangers and risks that exist in alpine terrain and confirm that they meet the athletic requirements in accordance with Clause 2.

 

5.       General

5.1.   If any provision (or part of a provision) of these Terms of Participation is invalid, illegal or unenforceable, the validity, legality or enforceability of the remainder of the terms of participation will not be affected or impaired.

5.2.   Zermatt Tourismus' failure to assert its rights in relation to any breach of these Terms of Participation shall not constitute a waiver of such rights, nor will any such waiver be implied.

5.3.   These Terms of Participation shall be governed by Swiss law, and the parties submit to the non-exclusive jurisdiction of the courts of Visp.

5.4.   If there is a difference between the German, English or French version of these Terms of Participation, the German version shall prevail.
